DMCA Policy

How to tell us that material hosted on Darwa infringes your copyright, and how a customer can contest that claim.

In short
  • Send notices to dmca@darwa.com. We acknowledge within 1 business day.
  • Valid notices are actioned within 5 business days and forwarded to the customer.
  • Customers may file a counter-notice; access is restored after 10 business days unless court action begins.
  • Repeat infringers lose their accounts.

Filing a notice

Your notice must include all of the following, or we will ask you to resubmit:

  • Identification of the copyrighted work you claim has been infringed.
  • The exact URL or path of the material, specific enough for us to locate it.
  • Your name, postal address, telephone number, and email address.
  • A statement that you have a good-faith belief the use is not authorised by the rights holder, an agent, or the law.
  • A statement, under penalty of perjury, that the information is accurate and that you are the rights holder or authorised to act for them.
  • Your physical or electronic signature.
Careful

Knowingly filing a false notice carries liability for damages and legal costs. If you are unsure whether a use is infringing, take advice before submitting.

We disable the narrowest thing that addresses the complaint. Where material sits inside a running application we contact the customer first, unless the claim concerns material that is plainly published.

Filing a counter-notice

If you are a customer and believe material was removed in error, send us:

  • Identification of the material and where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good-faith belief it was removed by mistake or misidentification.
  • Your name, address, telephone number, and email.
  • Consent to the jurisdiction of the DIFC Courts, or of your local courts if you are outside the UAE.
  • Your signature.

Repeat infringers

Three valid, uncontested notices within 12 months results in account termination. We keep a record of notices for this purpose and count only those that were not successfully countered.

Transparency

We publish an annual count of notices received, actioned, and countered, with no customer identifying information.
